Beardsage operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience for beard care, grooming and personal care products (the "Services"). Beardsage is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when you visit, interact with, or use our Services.

SECTION 2 - OUR PRODUCTS
Every Beardsage formula is developed and produced in small batches with an emphasis on ingredient transparency, documented sourcing, and careful compliance review, because we want you to trust what's in the bottle as much as you trust how it performs.
Beardsage offers cosmetic grooming products intended for external use only. Our products are designed for beard care, skin and body care, grooming, conditioning, scent, and personal care purposes.
Beardsage products are not intended to diagnose, treat, cure, or prevent any disease, medical condition, skin disorder, hair-loss condition, or other health condition. Any product descriptions, educational content, grooming tips, ingredient explanations, or related content provided through the Services are for general informational purposes only and are not medical advice.
Please review the full ingredient list before purchasing or using any product. Our products may contain botanical oils, seed oils, nut-derived oils, essential oils, fragrance oils, aromatic compounds, vitamin E, plant-based ingredients, and other cosmetic ingredients that may not be suitable for every individual.
We recommend patch testing before first use, especially if you have sensitive skin, allergies, fragrance sensitivities, a history of skin irritation, or a known sensitivity to any cosmetic ingredient. Avoid contact with eyes. Do not apply to broken, irritated, or inflamed skin. If irritation, redness, itching, burning, rash, or discomfort occurs, discontinue use and consult a qualified professional.
We have made every effort to provide accurate descriptions and representations of our products. However, product appearance, label color, packaging color, oil color, texture, or other visual details may differ from how they appear on your screen due to device settings, photography, lighting, and display differences.
We do not warrant that the appearance, scent, texture, performance, or quality of any product purchased by you will meet your personal expectations or be exactly as depicted or described online.
All descriptions, formulas, ingredients, product names, scent profiles, packaging, availability, and prices are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products we offer to any person, geographic region, or jurisdiction, on a case-by-case basis.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Beardsage reserves the right to accept or decline your order for any reason at our discretion. Your order is not accepted until Beardsage confirms acceptance. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting it. Because we may begin processing orders shortly after they are placed, Beardsage may be unable to accommodate cancellation or change requests after an order is accepted.
In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email address, billing address, shipping address, or phone number provided at the time the order was placed.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 - PRICES AND BILLING
Prices, discounts, promotions, product availability, and offers are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email.
Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs, import charges, or other applicable fees.
Prices posted in our online store may differ from prices offered in physical stores, pop-up events, wholesale channels, marketplaces, or other third-party stores. We may offer promotions from time to time that may affect pricing and that are governed by separate terms and conditions. If there is a conflict between the terms for a promotion and these Terms of Service, the promotion terms will govern.
You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made through our store. You agree to promptly update your account and other information, including your email address, payment information, and shipping address, so that we can complete your transactions and contact you as needed.
You represent and warrant that:

• you are duly authorized to use such payment method for the purchase;
• charges incurred by you will be honored by your payment provider; and
• you will pay all charges incurred by you at the posted prices, including shipping, handling, and all applicable taxes, if any.
SECTION 5 - SHIPPING AND DELIVERY

All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, holidays, customs processing, incorrect addresses, delivery interruptions, supply delays, or events outside our control.
Once we transfer products to the carrier, title and risk of loss pass to you to the extent permitted by applicable law. If your package is marked as delivered but you cannot locate it, please contact the carrier and our customer support team so we can assist where possible.
You are responsible for providing a complete and accurate shipping address. Beardsage is not responsible for orders shipped to an incorrect or incomplete address provided by the customer.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, audio, product names, scent names, product descriptions, designs, logos, slogans, and the design, selection, and arrangement thereof, are owned by Beardsage, its affiliates, or licensors and are protected by U.S. and foreign copyright, trademark, and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, scrape, or exploit any material from the Services without our prior written consent.
Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any trademark, copyright, or other intellectual property of Beardsage, Shopify, or any third party.
Unauthorized use of the Services may be a violation of federal and state intellectual property laws. All rights not expressly granted herein are reserved by Beardsage.
Beardsage's names, logos, product and service names, designs, slogans, product photography, labels, and brand assets are trademarks, trade dress, copyrighted works, or other intellectual property of Beardsage or its affiliates or licensors. You must not use such materials without the prior written permission of Beardsage.
Shopify's name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans appearing through the Services are the trademarks of their respective owners.
SECTION 7 - OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have control over.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional third-party tools offered through the Services is entirely at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms on which those tools are provided by the relevant third-party provider.
We may also, in the future, offer new features through the Services, including the release of new tools and resources. Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

If you decide to leave the Services to access third-party materials or third-party sites, you do so at your own risk.
We are not liable for any harm, damages, losses, or claims related to your access to any third-party websites, or your purchase or use of any products, services, resources, or content from any third-party websites. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third party.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Beardsage is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Beardsage.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Beardsage, including any injury, damage, or loss resulting from purchased products and services.
You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Beardsage.
SECTION 10 - PRIVACY POLICY AND DATA COLLECTION

We may collect and process information such as your name, email address, phone number, billing address, shipping address, payment-related information, order history, purchase history, customer service communications, product preferences, browsing activity, cart activity, product views, device information, IP address, approximate location information, email engagement, SMS/MMS/RCS engagement, marketing preferences, and other information you provide or that is collected through your use of the Services.
We use this information to operate our store, process orders, provide customer support, communicate with you, send transactional updates, personalize your experience, improve our Services, measure performance, prevent fraud, comply with legal obligations, and, where permitted, send marketing communications.

SECTION 11 - MARKETING COMMUNICATIONS, EMAIL, SMS, MMS, AND RCS
By providing your email address or phone number and subscribing to Beardsage marketing communications, you agree to receive marketing and promotional messages from Beardsage. These messages may include product launches, promotions, discounts, cart reminders, back-in-stock alerts, order-related updates, grooming education, beard care tips, product recommendations, review requests, customer experience messages, and other brand communications.
Marketing messages may be sent by email, SMS, MMS, RCS, or similar messaging channels. Message frequency may vary but typically includes a minimum of 4 messages per month.
Text messages may be sent using an automatic telephone dialing system or similar technology. Consent to receive such messages is not required as a condition of any purchase.
Consent to receive marketing messages is not a condition of purchase. You may purchase products from Beardsage without agreeing to receive marketing text messages.
For SMS, MMS, RCS, and similar mobile messaging programs, message and data rates may apply. Message frequency varies. You may opt out of mobile marketing messages at any time by replying STOP. You may request help by replying HELP or by contacting us at info@beardsage.com.
For email marketing, you may unsubscribe at any time by clicking the unsubscribe link included in our marketing emails or by contacting us at info@beardsage.com.
We may use third-party service providers, including Klaviyo, to help us send, manage, personalize, measure, and improve our email, SMS, MMS, RCS, and other marketing communications. These providers may process information such as your name, email address, phone number, purchase history, browsing activity, cart activity, product views, communication preferences, message engagement, and related data in accordance with our Privacy Policy.
Opting out of marketing communications does not prevent us from sending non-marketing transactional or service-related communications where permitted by law, such as order confirmations, shipping updates, delivery updates, account notices, customer service responses, or important information about your purchase.
Carriers are not liable for delayed or undelivered mobile messages.

We're grateful when customers take the time to share their experience with us. Honest feedback and reviews - good and bad - are how we keep improving our formulas, and we do not alter, fabricate, or selectively suppress reviews in bad faith.
If you submit, upload, post, email, tag us in, message us, or otherwise transmit any ideas, suggestions, feedback, reviews, testimonials, photos, videos, proposals, plans, social media content, or other content relating to Beardsage or the Services, collectively "Feedback," you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, display, and create derivative works from such Feedback in any medium for any purpose, including commercial, promotional, advertising, educational, and operational purposes.
We may, for example, use Feedback to operate, provide, evaluate, enhance, improve, and promote the Services, including by sharing reviews, testimonials, customer comments, photos, or videos on our website, email marketing, SMS/MMS/RCS marketing, advertisements, social media accounts, product pages, and other marketing channels.
You represent and warrant that:
• you own or have all necessary rights to the Feedback;
• your Feedback is truthful and reflects your honest experience;
• you have disclosed any compensation, free product, discount, incentive, affiliate relationship, or material connection received in connection with your Feedback; and
• your Feedback complies with these Terms.
We are under no obligation to:
• maintain your Feedback in confidence;
• pay compensation for your Feedback; or
• respond to your Feedback.
We may, but have no obligation to, monitor, edit, refuse, or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, obscene, misleading, deceptive, infringing, or otherwise objectionable, or that violates any party's intellectual property rights or these Terms of Service.
You agree that your Feedback will not violate any right of any third party, including copyright, trademark, privacy, personality, publicity, or other personal or proprietary rights. You further agree that your Feedback will not contain libelous, unlawful, abusive, obscene, false, misleading, or malicious content, or any computer virus or malware that could affect the operation of the Services.
You may not use a false email address, impersonate someone else, or otherwise mislead us or third parties as to the origin of any Feedback.
You are solely responsible for any Feedback you provide and its accuracy. We take no responsibility and assume no liability for any Feedback posted by you or any third party.
SECTION 13 - ERRORS, INACCURACIES, AND OMISSIONS
Occasionally there may be information on or in the Services that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, ingredients, scent descriptions, product availability, pricing, promotions, offers, product shipping charges, transit times, or availability.
We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice, including after you have submitted your order.
We undertake no obligation to update, amend, or clarify information in the Services, including without limitation pricing or ingredient information, except as required by law. No specified update or refresh date applied to the Services should be taken to indicate that all information in the Services has been modified or updated.
SECTION 14 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly:
• for any unlawful or malicious purpose;
• to violate any international, federal, state, provincial, or local law, regulation, rule, or ordinance;
• to infringe upon or violate our intellectual property rights or the intellectual property rights of others;

• to send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms;
• to transmit or procure the sending of any advertising or promotional material, including junk mail, chain letters, spam, or any other similar solicitation;
• to impersonate or attempt to impersonate any other person or entity;
• to interfere with or disrupt the operation of the Services;
• to collect or track personal information of others;
• to engage in fraudulent activity, payment fraud, chargeback abuse, or misuse of promotions; or
• to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm Beardsage, Shopify, or users of the Services, or expose them to liability.
In addition, you agree not to:
• upload or transmit viruses or any other type of malicious code;
• reproduce, duplicate, copy, extract, sell, resell, or exploit any portion of the Services;
• spam, phish, pharm, pretext, spider, crawl, scrape, or use automated tools to access the Services;
• use any robot, spider, scraper, data gathering and extraction tool, automatic device, AI tool, agentic AI tool, or automated or manual process to access, monitor, copy, or extract material from the Services without our prior written permission;
• interfere with, bypass, or circumvent security features, authentication measures, robot exclusion headers, or other measures we use to restrict access to the Services.
We reserve the right to suspend, disable, or terminate your account or access to the Services at any time, without notice, if we determine that you have violated any part of these Terms.

This section applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services.
"Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device without direct supervision.
No Agent may access, use, or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in this section. In addition, no Agent may access, use, or interact with the Services if we have requested that the Agent refrain from accessing, using, or interacting with any Service.
We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with the Services.
Agents must:
• in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]";
• not conceal or obfuscate that any access, use, or interaction is from an Agent, including by mimicking human behavior or interaction patterns;
• not complete or circumvent CAPTCHAs or measures intended to distinguish computer use from human use;
• respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or computer; and
• not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.
SECTION 16 - TERMINATION
We may terminate this agreement or your access to the Services, or any part thereof, in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
The following sections will continue to apply following any termination: Intellectual Property; Privacy Policy and Data Collection; Marketing Communications; Feedback, Reviews, and User Content; Termination; Disclaimer of Warranties; Limitation of Liability; Indemnification; Dispute Resolution; Force Majeure; Severability; Waiver; Entire Agreement; Assignment; Governing Law; and any other provisions that by their nature should survive termination.
SECTION 17 - DISCLAIMER OF WARRANTIES
We put real care into keeping our product, ingredient, and formula information accurate and up to date, and we stand behind the quality of every batch we produce. The disclaimers below are standard legal language required to protect the business - they don't reflect how seriously we take getting things right.
The information presented on or through the Services is made available solely for general informational purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk.
Beardsage product information, ingredient information, grooming tips, beard care education, scent descriptions, and related content are provided for general cosmetic and personal care purposes only. They are not medical advice and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Except as expressly stated by Beardsage, the Services and all products offered through the Services are provided "as is" and "as available" for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
We do not guarantee, represent, or warrant that your use of the Services will be uninterrupted, timely, secure, or error-free.
Some jurisdictions limit or do not allow the disclaimer of implied or other warranties, so the above disclaimer may not apply to you.
SECTION 18 - LIMITATION OF LIABILITY
To the fullest extent provided by law, in no case shall Beardsage, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, licensors, or those of Shopify and its affiliates, be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind.
This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, personal dissatisfaction with product scent, texture, appearance, or performance, or any similar damages, whether based in contract, tort, negligence, strict liability, or otherwise.
This limitation applies to claims arising from your use of any of the Services or any products procured using the Services, or for any other claim related in any way to your use of the Services or any product, including but not limited to any errors or omissions in content, or any loss or damage incurred as a result of the use of the Services or any content or product posted, transmitted, or otherwise made available through the Services, even if advised of their possibility.
To the extent any liability is not otherwise excluded or limited under this Section, you agree that our total, aggregate liability to you for any and all claims arising out of or relating to the Services or any product shall not exceed the amount you actually paid to Beardsage for the product(s) giving rise to the claim in the twelve (12) months preceding the claim.
Nothing in these Terms is intended to limit liability where such limitation is not permitted by applicable law.
SECTION 19 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Beardsage, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, claims, or expenses, including reasonable attorneys' fees, payable to any third party due to or arising out of:
• your breach of these Terms of Service or the documents they incorporate by reference;
• your violation of any law or the rights of a third party;
• your access to and use of the Services;
• your misuse of any product purchased through the Services; or
• any Feedback or content you submit.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced.
We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent, not to be unreasonably withheld.
You will cooperate in the defense of indemnified claims, including by providing relevant documents.
SECTION 20 - DISPUTE RESOLUTION; ARBITRATION; CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Any dispute, claim, or controversy arising out of or relating to these Terms of Service, the Services, or any product purchased through the Services shall be resolved by binding arbitration on an individual basis, rather than in court, except that either party may bring an individual action in small claims court.
You and Beardsage each waive the right to a trial by jury and the right to participate in a class action, collective action, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class or representative proceeding.
This arbitration provision does not apply to: (i) claims for injunctive or equitable relief; (ii) claims relating to intellectual property rights; or (iii) claims that, under applicable law, cannot be subject to mandatory arbitration.
You may opt out of this arbitration provision within 30 days of first accepting these Terms by sending written notice to info@beardsage.com with your name, order number (if any), and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will instead be resolved under Section 25 (Governing Law).
The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, available at www.adr.org. Payment of all filing, administration, and arbitrator fees will be governed by the AAA Consumer Arbitration Rules. The arbitration will be conducted in the English language, and unless you and Beardsage agree otherwise, any in-person hearing will take place in Nassau County, New York, or, where required by the AAA Consumer Arbitration Rules, in a location reasonably convenient to you. Judgment on the arbitration award may be entered in any court having jurisdiction.
SECTION 21 - FORCE MAJEURE
We will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic or public health emergency, fire, flood, war, terrorism, civil unrest, labor disputes, governmental action, supplier or raw material shortages (including essential oil, carrier oil, fragrance, or packaging component shortages), transportation or logistics disruptions, or failures of third-party service providers such as Shopify or our shipping carriers. Performance of affected obligations will be suspended for the duration of the event, and we will make reasonable efforts to notify you and resume performance as soon as reasonably practicable.
